Marcus City Council Meeting & Claims
Regular Meeting of the City Council was September 9th, 2024, at 5:00 pm with Mayor Bunt presiding. Council members present: Ebert, Jenness, Schmillen, Whited. Absent, Edwards.
Pledge of Allegiance
Motion by Ebert, seconded by Whited to approve Consent Agenda: City Council Minutes, Bills, Res #24-29, “Transfer of Funds”, Tax Abatement Under the Marcus Urban Revitalization Plan for Kent Leavitt. Ayes: Ebert, Jenness, Schmillen, White. Nayes: none. Motion carried.
Issac Cruz, Cruz Electric shared Mid-America’s Small Business Express Program that gives rebates for changing fluorescent lights to LED. The Council gave direction to Cruz to do an estimate of City buildings needing to upgrade at no cost.
Clerk Harvey informed the Council she has been selected for Northwestern’s Accelerate Siouxland Leadership Program. The class will be held every second Thursday through April. Clerk Harvey will attend the Iowa League of Conferences in Sioux City September 19th and 20th and IMWCA Reporting Training in Sioux City October 1st.
Chief Flikeid gave his arrest report, there was a Suicide Awareness Walk at the school on August 30th following the football game. Officer Stephens and Vulcan attended dog trials and were recertified and won the overall competition. They will now go to Nationals in Baton Rouge, LA in October. There is concern about kids walking to school on the south side crossing the street. A stop signs have been recommended at the corners of Highland Dr. and Elm St.
No public works report. The Mayor let the Council know that McClure has the test well results and they are reviewing them.
Motion by Schmillen, seconded by Ebert to approve the refurbished emergency siren for the south end of town. Ayes: all Nayes: none. Motion carried.
Motion by Jenness, seconded by Whited to approve Resolution #24-30, ““Resolution Approving Council Procedural Policy”. Ayes: all Nayes: none. Motion carried.
Motion by Schmillen, seconded by Jenness to approve first reading of Ordinance #361, “An Ordinance Amending the Code of Ordinances of the City of Marcus, Iowa by Amendments and Adoption of Provisions Pertaining to Park Regulations” Ayes: Ebert, Jenness, Schmillen, Whited. Nayes: none. Motion carried.
Motion by Jenness, seconded by Whited to approve waiving the second and third reading of Ordinance #361. Ayes: Ebert, Jenness, Schmillen, Whited. Nayes: none. Motion carried.
The first reading of ordinance 362 was tabled for the October meeting.
5:28pm Motion by Ebert, seconded by Schmillen to enter closed session per Iowa Code 21.5 (1)(2). Ayes: Ebert, Jenness, Schmillen, Whited. Nayes: none. Motion carried.
6:06pm Motion by Jenness, seconded by Schmillen to exit closed session. Ayes: Ebert, Jenness, Schmillen, Whited. Nayes: none. Motion carried.

ORDINANCE NO. 361
AN ORDINANCE AMENDING THE CODE OF ORDINANCES
OF THE CITY OF MARCUS, IOWA BY ADOPTION OF PROVISIONS PERTAINING TO PARK REGULATIONS
BE IT ENACTED by the City Council of the City of Marcus, Iowa:
SECTION 1. SUBSECTION ADDED. Subsections 47.07 to 47.08 of the Code of Ordinances of the City of Marcus, Iowa are hereby adopted:
46.07 POSTED SIGNS. All posted signage in City parks shall be enforced. A violation of this section shall constitute a simple misdemeanor.
46.08 RECREATIONAL/WALKING TRAIL. The trail system located within the City limits is herby designated as part of the City’s “park facilities” within the meaning of this chapter. All regulations set forth in this chapter apply to the trail system. However, the trail system does not close between the hours set forth in Section 46.05.
