NOTICE OF PROBATE OF WILL, OR APPOINTMENT OF EXECUTOR, AND NOTICE TO CREDITORS
To All Persons Interested in the Estate of Jeanette L. Schuetz, Deceased, who died on or about November 22, 2021:
You are hereby notified that on December 15, 2021, the last will and testament of Jeanette L. Schuetz, deceased, bearing date of June 9, 1999, was admitted to probate in the above named court and that Steven Schuetz was appointed executor of the estate. Any action to set aside the will must be brought in the district court of said county within the later to occur of four months from the date of the second publication of this notice or one month from the date of mailing of this notice to all heirs of the decedent and devisees under the will whose identities are reasonably ascertainable, or thereafter be forever barred.
Notice is further given that all persons indebted to the estate are requested to make immediate payment to the undersign, and creditors having claims against the estate shall file them with the clerk of the above named district court, as provided by law, duly authenticated, for allowance, and unless so filed by the later to occur of four months from the date of the second publication of this notice or one month from the date of mailing of this notice (unless otherwise allowed or paid) a claim is thereafter forever barred.

Marcus City Council Special Meeting
Special Meeting of the City Council met January 3rd, 2022 at 5:00 pm with Mayor Bunt presiding Council Members present: Ebert, Jenness, Enneking, Schmillen, and Frangione. Also, present: Matt Dreckman, Doug Dreckman, Mitze Klingenberg, Dianne Klassen, Larry Rapagnani, Grant Leavitt, and Brian Flikeid.
Pledge of Allegiance.
The Council entered work session for the FY22-23 budget. Regular meeting was held after completion of budget discussion.
Motion by Jenness, seconded by Enneking to approve water usage by the Cemetery Board. All ayes. Nayes: none. Motion carried.
Motion by Ebert, seconded by Frangione to approve hiring Cody Woebke for the Police Department part-time. All ayes. Nayes: none. Motion carried.
7:10 pm Motion by Ebert, seconded by Jenness to approve to enter closed session per Iowa Code Section 21.5(1)(j). Roll call vote Ebert, Jenness, Enneking, Schmillen, and Frangione. Nayes: none. Motion carried.
7:25 pm Motion by Enneking, seconded by Schmillen to exit closed session. Roll call vote: Ebert, Jenness, Enneking, Schmillen, and Frangione. Nayes: none. Motion carried.
Motion by Frangione, seconded by Enneking to authorize Mayor Bunt to act on closed session matter. Ayes: all. Nayes: none. Motion carried.

Cherokee County Board of Supervisors Meeting
The Cherokee County Board of Supervisors met in regular session on Tuesday, December 28, 2021 with Rick Mongan, Wane Miller, Gary Lundquist, Bryan Petersen, and Duane Mummert present. There were no representatives from the press. Glen McCannon, William Gauthier, Justin Pritts and Stu Hogg were also in attendance. Unless otherwise indicated, all votes were offered as follows: Ayes – Mongan, Petersen, Mummert, Miller, Lundquist; Nayes – none; Abstentions – none.
The Pledge of Allegiance was led by Wane Miller, Veteran Affairs Commissioner.
Motion by Mongan, seconded by Petersen to approve the agenda. Motion carried.
Motion by Miller, seconded by Mummert to approve the minutes of the previous meeting. Motion carried.
Motion by Mongan, seconded by Mummert to approve the claims for payment as presented. Motion carried. A complete listing is available for review in the County Auditor’s office and online.

Dick Sievers, Mid Sioux Opportunity, gave an informative review of services offered to area residents and reported that 1,283 individuals and 635 households received services in Cherokee County; which returns $254 for every dollar contributed by the county. Mid Sioux’s $9,000 budget request for 2022/2023 is the same as it has been for the past several years. The request will be considered during the budget process.
Dave Skou and Brian Flikeid reviewed a resolution which supports second amendment rights of citizens and asked the supervisors to consider adopting the document as a show of support for the constitution. After a lengthy discussion, action was tabled for review of an updated draft of the resolution.
Derek Scott, County Sheriff, was unable to attend due to illness, but his proposal to increase shift differential pay for Law Enforcement Center employees was reviewed.
Motion by Mummert, seconded by Mongan to adjust the night shift differential hours to 7:00 p.m. – 7:00 a.m. and to increase the shift differential pay to $2 per hour for all jailers, dispatchers and hourly deputies effective July 1, 2022. Motion carried.
Sarah Tracy, County Engineer, discussed Title VI requirements as recommended by the Iowa DOT.
Motion by Mummert, seconded by Miller to authorize the chairman to sign a Title VI Non-Discrimination Agreement with Iowa DOT. Motion carried.
Motion by Miller, seconded by Petersen to authorize the chairman to sign a Title VI Standard Assurances document. Motion carried.
Motion by Petersen, seconded by Mongan to approve a Cherokee County Organizational Chart to be submitted to the Iowa DOT. Motion carried.
Stu Hogg, IT Director, discussed a proposed HVAC system upgrade in the courthouse.
Motion by Mummert, seconded by Mongan to approve a “Cherokee County Provider and Program Participation Agreement” for fiscal year 2022 county funding of covered services provided by Cherokee Regional Medical Center Ambulance Services for the benefit of Cherokee County citizens and individuals. Motion carried.
The supervisors provided committee reports and reviewed meeting schedules.
Lundquist called for comments from the public. Sarah Tracy discussed the Secondary Roads budget and long-term construction project plans. Stu Hogg reported that electronic door locks have been installed on clerk of court doors and other county office doors should be completed soon. William Gauthier expressed support for upholding the constitution in Cherokee County.
There being no further business, Chairman Lundquist adjourned the meeting at 10:42 a.m.
