Notice is hereby given that the City Council of the City of Marcus, Iowa, will hold a public hearing regarding the proposed Partial Release of Easement relating to certain real property within the City of Marcus, Cherokee County, Iowa.
The purpose of the hearing is to receive public comment and consider approval of a Partial Release of Easement (the “Release”) for the following property which was erroneously included in a Trail Easement Agreement and is not necessary for use of the easement:
• Lot One (1) of Ebert Addition to Marcus, City of Marcus, Cherokee County, Iowa (“Lot One”)
The City of Marcus is the holder of a Trail Easement Agreement from The Royal Apartments, dated August 9, 2023, and filed in the records of the Cherokee County Recorder on August 24, 2023, in Doc. #23-141 (the “Easement”). The proposed action will permanently release and discharge Lot One from all terms and conditions of the Easement. This Release is expressly limited to Lot One and shall not affect any other rights, obligations, or interests in any other property described in the Easement, nor shall it impact any other easement rights of the City. The hearing shall be held on 14th of July 2025 at 5:00pm in the Council Chambers, City Hall, Marcus, Iowa.
All interested persons are invited to attend the public hearing and provide comments either in person or in writing regarding the proposed Partial Release of Easement. Written comments may be submitted to the City Clerk prior to the hearing.
