Cherokee County Board of Supervisors Meeting
The Cherokee County Board of Supervisors met in regular session on Tuesday, October 26, 2021 with Gary Lundquist, Rick Mongan, Bryan Petersen, Duane Mummert, and Wane Miller present. There were no representatives from the press. Derek Scott, Sarah Tracy and Joel Ehrig were also in attendance. Unless otherwise indicated, all votes were offered as follows: Ayes – Mongan, Petersen, Mummert, Miller, Lundquist; Nayes – none; Abstentions – one.
The Pledge of Allegiance was led by Wane Miller, Veteran Affairs Commissioner.
Motion by Miller, seconded by Mongan to approve the agenda. Motion carried.
Motion by Mummert, seconded by Mongan to approve the minutes of the previous meeting. Motion carried.

Derek Scott, County Sheriff, presented a wage authorization for consideration.
Motion by Mummert, seconded by Mongan to approve a $21.45 per hour wage authorization for Celeste Mohr, Part-Time Dispatcher, effective October 26, 2021. Motion carried.
Sarah Tracy, County Engineer, presented construction documents and utility permits for consideration.
Motion by Mummert, seconded by Mongan to approve a Title Sheet for project #L-87–73-18 as presented. Motion carried.
Motion by Mongan, seconded by Petersen to approve an underground construction application on county right of way for WesTel Systems in Sections 29 and 32 of Tilden Township. Motion carried.
Motion by Miller, seconded by Mummert to approve an underground construction application on county right of way for CML Telephone in Sections 13 and 24 of Liberty Township. Motion carried.
Tracy presented an updated floodplain ordinance for review.
Motion by Mongan, seconded by Mummert to approve publication of a summary of the proposed Floodplain Ordinance and to set the first reading for 9:00 a.m. on November 9, 2021. Motion carried.
Motion by Mongan, seconded by Petersen to approve a separation of employment and $5,424.97 final payout of vacation, comp and hours worked for Brian Olson, Secondary Roads General Foreman, effective October 22, 2021. Motion carried.
Motion by Mummert, seconded by Miller to approve a separation of employment and $3,453.18 final payout of vacation, comp and hours worked for Mark Wilson, Conservation Maintenance Technician, effective October 17, 2021. Motion carried.
Motion by Miller, seconded by Petersen to approve Resolution #2021-16 “WHEREAS, the Iowa County Recorders Association and Cherokee County, Iowa entered into a County Electronic Services System 28E Agreement in 2005; and NOW THEREFORE, BE IT RESOLVED by the Cherokee County Board of Supervisors of Cherokee County, Iowa, that the Amended and Substituted County Electronic Services System 28E Agreement, in conjunction with the Iowa County Recorders Association, is hereby approved.” Roll call vote: Mongan-aye, Petersen-aye, Mummert-aye, Miller-aye, Lundquist-aye. Motion carried and resolution adopted.
Motion by Mummert, seconded by Petersen to approve a 28E Agreement between the Iowa Recorders Association and Cherokee County “NOW THEREFORE, the undersigned counties and the Iowa County Recorders Association hereby Amend and Substitute the aforementioned County Electronic Services System 28E Agreement entirely with this AMENDED AND SUBSTITUTED COUNTY ELECTRONIC SERVICES SYSTEM 28E AGREEMENT for the purpose of continuing the Electronic Services System administering the county land records information system, a/k/a/ Iowa Land Records, and other services. The purpose of the Electronic Services System was to establish a system and the necessary associated infrastructure to enable the recordation of various land records by interested parties in all areas of the State, and to provide reasonable public access to the public to land record information, while assuring that personally identifiable information was redacted in accordance with Iowa Law prior to public access to such records through the system.” Roll call vote: Mongan-aye, Petersen-aye, Mummert-aye, Miller-aye, Lundquist-aye. Motion carried and 28E agreement adopted.
Motion by Mummert, seconded by Mongan to approve Resolution #2021-17 “WHEREAS, Cherokee County previously signed a resolution to approve the Articles of Agreement creating the Workforce Development Chief Elected Official Consortium (CEO) together with 17 other counties in western and southwestern Iowa, known as the ‘Western Iowa Workforce Development Area’ or WILWDA; WHEREAS, a quorum of the CEO has been difficult to meet, hindering the ability of the CEO to conduct business and provide for smooth operation of the WILWDA; and, WHEREAS, at their September, 2021 meeting the CEO discussed proposing to the member counties an amendment to the Articles of Agreement to reduce the required quorum from a supermajority (three-fifths or 11 members) to having a minimum of seven members (one-third + 1). NOW THEREFORE, BE IT RESOLVED by the Cherokee County Board of Supervisors that it does hereby agree to amend Article 5C of the Articles of Agreement which formed the WILWDA Chief Elected Official Consortium to read as follows: C. A quorum of the member counties is required to conduct a meeting. A quorum is defined as one plus one-third of the members.” Roll call vote: Mongan-aye, Petersen-aye, Mummert-aye, Lundquist-aye. Miller abstained. Motion carried and resolution adopted.
Motion by Petersen, seconded by Mummert to approve a “Cherokee County Provider and Program Participation Agreement” for fiscal year 2022 county funding of covered services provided by the Marcus Public Library for the benefit of Cherokee County citizens and individuals. Motion carried.
The board discussed property and technology security policies with Ryan Kolpin, County Attorney. Kolpin advised that Cherokee County should not allow former employees access to county facilities or technology and the county does not want to set a precedent by allowing specific exceptions. Consensus of the board was to continue Cherokee County’s past practice that any time a person’s employment with the county ends; they no longer have access to county software, computer systems, offices, buildings or county property in general. Kolpin will meet with the Chairman of the Board, IT Director and HR Consultant to potentially draft a written policy.
The supervisors provided committee reports and reviewed meeting schedules.
Lundquist called for comments from the public. Sarah Tracy, County Engineer, reported on construction projects, an early retirement package offer, and the status of filling an open operator position.
There being no further business, Chairman Lundquist adjourned the meeting at 10:35 a.m.
