Cherokee County Board of Supervisors Meeting
The Cherokee County Board of Supervisors met in regular session on Tuesday, November 14, 2023 with Rick Mongan, Bryan Petersen, Duane Mummert, Cheryl Ellis and Dave Skou present. Erin Rydgren, Chronicle Times, represented the press. Gary Lundquist, Steve Zarr, Joel Ehrig, Nissa White, Sarah Tracy, Kelly Puhrmann and Kenny Schlenger were also in attendance. Unless otherwise indicated, all votes were offered as follows: Ayes – Ellis, Skou, Mummert, Petersen, Mongan; Nayes – none; Abstentions – none.
Chairman Mongan called the meeting to order at 9:00 a.m. and led the Pledge of Allegiance.
Motion by Skou, seconded by Petersen to approve the agenda. Motion carried.
Motion by Ellis, seconded by Mummert to approve the minutes of the previous meeting. Motion carried.

Steve Zarr, Survey Engineering Technician, presented one utility permit for consideration.
Motion by Mummert, seconded by Petersen to approve an underground construction on county right of way application for Cherokee Rural Water in Sections 20 and 29 of Cedar Township. Motion carried.
Sarah Tracy, County Engineer, presented an additional right of way application and requested consideration of selling a county owned shed in Washta.
After discussion, a right of way application from the University of Iowa for drilling two wells at the Mill Creek Bridge site was tabled until more information is provided.
Motion by Skou, seconded by Mummert to approve Resolution #2023-20 DESIRE TO SELL REAL PROPERTY
WHEREAS, the Board of Supervisors for Cherokee County, Iowa, desire to sell the following described real property:
Lot Six (6) of Block Fourteen (14) in the Original Town of Washta, Iowa, except a tract of land beginning at the Southeast Corner of Lot Six (6) in Block Fourteen (14) original town of Washta, Iowa, thence running due North along the East side of said lot a distance of Twenty-five (25) feet, thence due West a distance of Twenty-five (25) feet, thence due South a distance of Twenty-five (25) feet, thence due East a distance of Twenty-five (25) feet to the point of beginning.
WHEREAS, Cherokee County intends to sell the property to the highest bidder and reserve the right to reject any and all bids, and
WHEREAS, Cherokee County gives notice that any abstracting fees will be the responsibility of prospective buyer, and
WHEREAS, Cherokee County believes said sale to be in the best interest of the public.
NOW, THEREFORE, the Board of Supervisors for Cherokee County, Iowa, hereby resolves to sell the above-described real estate to the highest bidder retaining the right to reject any and all bids. Said transfer will be by quit claim deed if sale is approved.
Further, the Cherokee County resolves that said sale should occur following published notice as provided in Iowa Code Section 331.305.
Roll call vote: Petersen-aye, Ellis-aye, Mummert-aye, Skou-aye, Mongan-aye. Motion carried and resolution adopted.
Tracy asked for the topic of funding F Avenue to be tabled until the engineer’s staff has time to review budget projections.
A review of current construction projects was provided by Sarah Tracy, County Engineer: Bridges being replaced on 640th Street and L48 should be completed by the end of the year; and a bridge replacement on 540th Street just off River Road will be closed until spring. Kenny Schlenger, Roads Superintendent, reported that crews are cleaning ditches, cutting trees and generally wrapping up projects before the snow flies.
Joel Ehrig, County Assessor, presented property tax credit applications for the board’s consideration. Ehrig presented the Family Farm waiver applications for 2023.
Motion by Mummert, seconded by Ellis to approve Family Farm applications for the 2023 assessment year with taxes payable in 2024/2025 and to disallow those that no longer qualify as recommended by the Cherokee County Assessor’s Office. Motion carried.
Kaitlin Letsche, Election Manager, reviewed the November 7, 2023 City-School Election results.
Motion by Skou, seconded by Petersen to certify the Canvass of 2023 City-School Election results. Motion carried by unanimous roll call vote with details as follows: Cherokee County Election Turnout of 23.9% with 1,923 of 8,046 registered voters casting a ballot.

Motion by Ellis, seconded by Petersen to approve Resolution #2023-21 CANVASS RESULTS OF VOTES OF QUIMBY SPECIAL MEASURE PROPOSITION
WHEREAS, the City Council of the City of Quimby, State of Iowa, heretofore did legally call a special election to be held on November 7, 2023, and ordered submitted thereat to the registered voters of the City, the following special measure proposition:
Summary: To authorize a change in the use of the one percent (1%) local sales and services tax in the City of Quimby effective July 1, 2024.
The use of the one percent (1%) local option sales and services tax shall be changed in the City of Quimby effective July 1, 2024.
PROPOSED USES OF THE TAX:
If the change is approved, revenues from the sales and services tax shall be allocated as follows:
0% for property tax relief.
The specific purposes for which the revenues shall otherwise be expended are:
100% for any lawful purpose.
CURRENT USES OF THE TAX:
Revenues from the sales and services tax are currently allocated as follows:
0% for property tax relief.
100% Street, Water & Sewer improvements.
WHEREAS, legal, sufficient and timely notice of the submission of the proposition at the election and of the date and hours of the election, and of the voting precinct or precincts thereof, with their corresponding polling place or places, was duly published and a correct and complete copy of such proposition was posted at each polling place or places during the day of election throughout the hours thereof, all in strict compliance with the orders of the Board of Supervisors:
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF CHEROKEE COUNTY, STATE OF IOWA:
Section 1. That it is hereby found, determined and declared:
First – That said election was held and conducted in each of the voting precincts or precinct of the City at the respective polling place or places, pursuant to due notice, and in strict compliance with law, and that the proposition and the vote thereon complies strictly with law.
Second – That at said election, on the proposition above set out, there were cast 51ballots, of which 28 votes were cast “YES” and 22 votes were cast “NO” and 1 ballot was cast blank or defectively marked, the vote by precinct or precincts being as set forth and abstracted in the official tally list a copy of which is attached hereto.
That the total number of persons voting in the precinct or precincts at the election on the date, as is shown by the election registers and poll tally lists, was 51.
Third – Neither the above proposition nor any proposal incorporating any portion thereof, was submitted to the registered voters of such City within the six months preceding the date of the election canvassed hereby.
Section 2. That the proposition and the results of the vote thereon, shall be entered at large in the minutes book, all in conformity with Chapter 50, and in particular Section 50.24 of the Code of Iowa.
Section 3. That a copy of this Resolution, the Abstract of Votes and the original tally lists, are hereby delivered to the Commissioner of Elections for filing as required by law.

The supervisors reviewed procedures and results of the post-election audit conducted per regulations in HF516. A five-member audit board consisting of absentee board members met at the Cherokee County Courthouse on Monday, November 13, 2023 to verify the votes cast at the #4 Cherokee Precinct during the November 7, 2023 General Election. The County Auditor and Election Manager were also in attendance to observe the process. The audit team hand counted the votes cast for the Larrabee Council Member At Large race on the 30 ballots cast at the Cherokee polling site on election day. The team’s hand counted results were then compared to those reported by the ballot tabulator results tape generated at the polls on election night and found the results matched exactly. Extensive testing of the ballot tabulators is conducted by the Auditor’s Office in advance of every election to assure that the tabulators are accurately recording the votes from all ballot types.
Motion by Petersen, seconded by Ellis to certify the 2023 City-School Election Post-Election Audit results of the hand count of 30 ballots cast in the #4 Cherokee Precinct for Larrabee Council Member At Large race; which exactly matched the results tape of the ballot tabulating machine on election day. Motion carried.
The supervisors provided committee reports and reviewed meeting schedules.
Gary Lundquist reported that concrete work has begun on the landfill building with hopes of having the structure enclosed to allow cement work inside during winter weather.
There being no further business, Chairman Mongan called for a motion to adjourn the meeting.

MMC CSD Board of Directors Meeting
The Marcus-Meriden-Cleghorn School District Board of Directors met in regular joint session on Monday, November 20, 2023, at 6:30pm in the Marcu-Meriden-Cleghorn Commons, Marcus, IA along with the Remsen-Union Community School District Board of Directors.
