Regular Meeting of the City Council was held October 9th, 2023, at 5:00 pm with Mayor Bunt presiding. Council members present: Ebert, Frangione, Schmillen. Absent: Jenness, Enneking Also, present: Steve Schuetz, Elaine Rassel, Connie Edwards, Gary Edwards, Kenny Hohbach, Tim Holmes, Doug Dreckman, Darrell Downs, Brian Flikeid

Motion by Frangione, seconded by Ebert to approve Consent Agenda: City Council Minutes, Bills, Res #23-37, “Transfer Funds”, Res #23-38, “A Resolution Adopting the City of Marcus, Iowa Safety Manual”, Jeff’s Food Inc. Class E Retail Alcohol License, Application for Marcus Signage/Façade Program – Pizza Ranch. Ayes: Ebert, Schmillen, Frangione. Nayes: none. Motion carried.
Tim Holmes representing Smith Insurance gave the Council an Auto Owners Policy for builder’s risk for the Clubhouse to review. This will only be for the construction process. ICAP doesn’t carry builders risk insurance. Motion by Schmillen, seconded by Frangione to approve the policy. Ayes: all Nayes: none. Motion carried.

Tim Holmes representing the Marcus Community Golf Club discussed the upcoming Golf Club Silent Auction & Golf Cart raffle to be held November 11th at the Community Center. Motion by Schmillen, seconded by Frangione to approve auctioning off any times that would be considered property of the City of Marcus including but not limited to the bar with proceeds collected for the City. Ayes: all Nayes: none. Motion carried.
The draft of Ordinance 359, “Mobile Food Trucks” was presented and discussed. Revisions will be made and presented for approval at the November meeting.
City Clerk Robin Harvey updated the Council on the Planning & Zoning meeting held on September 29th with City Attorney Herbold and Dave Christensen, Code Enforcement. The agenda topic was items in the right of way. P&Z will not be amending the Code to specify allowable items in the right of way. The City has the authority to remove any items placed in the right of way without notice. Items that would be considered a nuisance is when the line of sight for cross traffic is blocked. Clerk Harvey will be the one to notify property owners when this is the case instead of Dave Christensen.
Doug Dreckman, Public Works gave the Council an update on the water plant. A new pump has been installed and is up and running properly after the old pump malfunctioned on September 30, 2023. Also, in the well the galvanized pipe was replaced with all stainless steel. The pool and park restrooms will be winterized now and trees along cemetery need to be cut down for the Spring Trail construction.
Police Chief Brian Flikeid gave his arrest report, a county wide critical incident debriefing standard procedure has been completed. MPD, Cherokee County and Public Health will have a wrecked car from drunk driving parked at the High School. Chief Flikeid asked the Council to consider gifting Cherokee County the Ford Taurus since they wrecked a vehicle and are looking for a new one. The County’s intentions are to give it to the YES Center after they get their new vehicle.
Motion by Frangione, seconded by Ebert to approve Res #23-39, “Resolution Declaring Declaration of Gift”. Ayes: all. Nayes: none. Motion carried.
Motion by Frangione, seconded by Schmillen to approve Res #23-40, “Setting Time and Place for Public Hearing on Sale of Lot in Business Lot”. Ayes: all. Nayes: none. Motion carried.
Mayor Bunt let the Council know that an intake outlet by Marcus Lumber is being replaced. The water plant is 70 years old and needs to be updated. More discussion will be held on that in upcoming council meetings. He invited any interested Council members to tour the water plant. City Hall will be closed Oct 17-Oct 19 while City Clerk is at training. Residential trick or treating is Oct 31st. Open burning is Oct 15th – Nov 15th.
Motion by Ebert, seconded by Frangione to adjourn at 5:40 pm. All ayes. Nayes: none. Motion carried.
