NOTICE OF VACANCIES
The Cherokee County Board of Supervisors is taking applications for various county board and commission appointments for the 2022 year. Cherokee County appreciates diversity in these appointments and welcomes all applicants at least 18 years of age. Terms and dates of appointments vary. These are unpaid positions. A brief description follows:
Aviation Authority: Five member board to provide guidance and oversee operations of the Cherokee Aviation Authority. Two residents living in the unincorporated territory of Cherokee County are appointed by the Board of Supervisors. Four year term.
Board of Health: Five member board responsible for policy and program direction for public health services offered including environmental health, disease prevention and investigation, health promotion and education, public health nursing, and home care services. Three year term.
Condemnation Compensation Commission: 28 member commission representing realtors, farmers, bankers, auctioneers and city property owners to be available to the chief judge of the judicial district to assess damages to property taken by eminent domain. One year term.
Civil Service Commission: Three member commission created and governed by Iowa Code Chapter 341A with duties pertaining to Civil Service for Deputy County Sheriffs. Six year term.
Conservation Board: Five member board to provide guidance and oversee operations of County Conservation Department. Five year term.
Township Officers where the Cherokee County Board of Supervisors have been granted the authority to make appointments by the electorate of the township. Four year terms to be appointed include: Township Clerk in Afton, Cedar, Cherokee, Liberty, Pilot, Willow and Township Trustees in Afton, Cedar, Cherokee, Diamond, Liberty, Sheridan, Silver, Spring, Willow.
Veterans Affairs Commission: Members of the five person Veterans Affairs Commission must be veterans, preferably of different wars. The commission is responsible for approving payments for relief provided to veterans by office staff. Office staff is supervised by the commission. Meetings are held monthly. Three year term.

National Pollutant Discharge Elimination System (NPDES)
Public Notice Date: October 15, 2021
The Iowa Department of Natural Resources is proposing to approve an application for issuance of an NPDES permit for the facility described below:

Facility Location: NE_ of Section 33, T92N, R42W, Amherst Township, Cherokee County, Iowa
Description Of Facility: The applicant currently operates an open feedlot currently has a total maximum animal capacity of 3,500 head of beef cattle. Two earthen settled open feedlot effluent basin with a total storage capacity of 387,400 gallons is serving a total drainage area of 16.77 acres. There must be no discharge except when precipitation events greater than the 25-year, 24-hour rainfall event (5.1 inches) causes an overflow of the production area, that is designed, constructed, operated and maintained to contain manure, open feedlot effluent, settled open feedlot effluent, settleable solids or process wastewater and have a NPDES permit as required by State and Federal rules. Generated manure and effluent must be land applied according to the DNR approved nutrient management plan (NMP).

Anyone wishing to comment on or object to the proposed issuance of this permit must do so in writing within forty-five (45) days of the date shown at the top of this notice. All comments received will be considered in the final determination. If no objections are received within forty-five (45) days, the Department will issue a final permit. Anyone desiring a public hearing must cite their specific reasons why a hearing should be held. Copies of the proposed permit and other information may be viewed online using the Wastewater Permit Information Exchange (WWPIE) system at https://programs.iowadnr.gov/wwpie/ by clicking on search and then change permit status to “draft” or from 8:00 AM to 4:30 PM Monday through Friday at the above street address. Council Meeting
Regular Meeting of the City Council was held October 11th, 2021 at 5:00 pm with Mayor Hansen presiding. Council members present: Ebert, Jenness, Enneking, Klassen, Frangione. Also, present: Steven Schuetz, Elaine Rassel, Pat Bunt, Doug Dreckman, Gary Edwards, Connie Edwards, Brian Flikeid

Doug Dreckman, Public Works shared estimates for repairing a broken sewer pump or replacing it with a new pump. This pump is used minimal for overflow and is not an emergency situation. The Council is interested in learning more about warranties for the pump and installation cost before deciding to rebuild or get a new pump. A sewer pump maintenance agreement was shown to the Council. The Council felt the agreement is not beneficial for the needs of Marcus. Doug explained that there is a water tower pipe that it has holes in it. Jensen Well will be coming in the next few weeks to replace it.
Motion by Frangione, seconded by Jenness to approve Mid-American running power off a street light for the Chamber Christmas tree lights. Ayes: All. Nayes: None. Motion carried.
Chief Flikeid gave a report that he received two LIFEPAK CR2 Defibrillators (AED) through a grant. With this grant training, resupply of patient pads, and manufacture support will be available for the next eight years. An arrest report was also given.
The Council was given the Street Finance Report and the Annual Finance Report for review.
Mayor Hansen let the Council know that Robin Harvey will be gone Oct 20-Oct 22 to Des Moines for a Clerk Conference. Open burning will be Oct 15th-Nov 15th. Trick or treating will be Sunday, Oct. 31st 5pm-7pm.

Cherokee County Board of Supervisors Meeting
The Cherokee County Board of Supervisors met in regular session on Tuesday, September 28, 2021 with Gary Lundquist, Rick Mongan, Bryan Petersen, Duane Mummert, and Wane Miller present. There were no representatives from the press. Lloyd Mattoon, Kenny Schlenger, Laura Jones, Hannah Nelson, Sarah Tracy, Kelly Puhrmann, Justin Pritts and Stu Hogg were also in attendance. Unless otherwise indicated, all votes were offered as follows: Ayes – Mongan, Petersen, Mummert, Miller, Lundquist; Nayes – none; Abstentions – none.
The Pledge of Allegiance was led by Wane Miller, Veteran Affairs Commissioner.
Motion by Petersen, seconded by Miller to approve the agenda. Motion carried.

Sarah Tracy, County Engineer, presented utility permits, construction documents and wage authorizations for consideration.
Motion by Petersen, seconded by Mongan to approve an underground construction application on county right of way for Iowa Lakes Electric Cooperative in Section 18 of Silver Township. Motion carried.
Motion by Mummert, seconded by Miller to approve an underground construction application on county right of way for Iowa Cherokee Rural Water in Section 11 of Cherokee Township. Motion carried.
Motion by Mummert, seconded by Miller to authorize board signatures on title sheets for three bridge/structure designs for 2022 summer construction as prepared by Calhoun Burns. Motion carried.
Motion by Mongan, seconded by Mummert to approve a $27.00 per hour wage authorization for Josh Keck, Shop Foreman, effective October 4, 2021. Motion carried.

Tracy discussed staffing transitions and will be posting to fill a full-time Construction Technician position with preference for applicants who have completed a college certification program.
Long term planning for buildings in the Roads Department were discussed. No action was taken as a result of the discussion.
Motion by Mummert, seconded by Petersen to acknowledge a $22.00 per hour wage authorization for Hannah Nelson, Office/Naturalist Assistant, effective September 28, 2021 as previously approved by the Cherokee County Conservation Board. Motion carried.
Motion by Miller, seconded by Mongan to approve a separation of employment and $3,393.70 final payout of vacation, longevity and hours worked for Joel Kohn, Engineer Construction Technician, effective September 22, 2021. Motion carried.
Motion by Mongan, seconded by Miller to approve Resolution #2021-15 “Compensation of Members of Election Boards” WHEREAS, Iowa Code Chapter 49.20 authorizes the county board of supervisors to establish the compensation of members of election boards, and WHEREAS, the Cherokee County Board of Supervisors has not reviewed or otherwise considered the compensation paid to members of election boards in several years, and WHEREAS, changes in Iowa’s elections laws have required members of the election boards to adapt to new election laws and technologies, and an ever-increasing focus on procedures and security create additional challenges with finding new members, and WHEREAS, it is vital to the Cherokee County elections process to build and maintain a strong pool of election board members, and an increase in compensation would certainly help with the recruitment of new members, as well as the retention of those who have faithfully served over the years; NOW, THEREFORE BE IT RESOLVED that the Cherokee County Board of Supervisors hereby authorizes that, effective October 1, 2021, the compensation of election board members working on election day shall be a flat fee of $175 and $200 if the member serves as chair/manager of a precinct; $25 per official training session attended; $11.00 per hour for special precinct board members and $12.50 per hour if the member serves as chair/manager of the special precinct board.” Roll call vote: Mongan-aye, Petersen-aye, Mummert-aye, Miller-aye, Lundquist-aye. Motion carried and resolution adopted.
The supervisors provided committee reports and reviewed meeting schedules.
Lundquist called for comments from the public. Lloyd Mattoon, representing “The People of Southwest Cherokee County Iowa”, conveyed concerns that the voices of small acreage owners will not be heard. Mattoon read the following prepared statement: “We are concerned about the proposed wind turbine project that seems poised to encroach upon our homes. If there is place for these towers, we believe it should be in the flat lands to the north and east and not in our hills and valleys. The immense size of these towers with their red lights, noise, bird kills, and impact on our productive soils would forever change the character of our countryside.” Mattoon summarized his request by asking that land owners consider their neighbors before making their decisions. The supervisors thanked Mattoon for his comments and assured him that his concerns would be taken into consideration. Justin Pritts, Emergency Management Coordinator, reported on PPE stocks currently on hand in the county warehouse. Kelly Puhrmann, Assistant to the Engineer, reported on current construction projects and the status of older project closeouts.
There being no further business, Chairman Lundquist adjourned the meeting at 10:26 a.m.
