Cherokee County Board of Supervisors Meeting
The Cherokee County Board of Supervisors met in regular session on Wednesday, November 12, 2025 with Bryan Petersen, Cheryl Ellis, Dave Skou, Ray Mullins II and Shane Bellefy present. Madeline Combs, Chronicle Times, represented the press. Tony Puffett, Jillian Cates, Maria Murillo, Emily Ankenman, Justin Wills, Lara Afonso Martinez and Gauthier Dubois were also in attendance. Unless otherwise indicated, all votes were offered as follows: Ayes – Mullins, Ellis, Bellefy, Skou, Petersen; Nayes – none; Abstentions – none.
Chairman Petersen called the meeting to order at 9:00 a.m. and led the Pledge of Allegiance.
Motion by Mullins, seconded by Ellis to approve the agenda. Motion carried.
Motion by Skou, seconded by Bellefy to approve the minutes of the previous meeting. Motion carried.
Motion by Skou, seconded by Bellefy to approve the claims for payment as presented. Motion carried. A complete listing is available for review in the County Auditor’s office.

Maria Murillo and Jillian Cates, Auditor’s Election Assistants, reviewed the November 4, 2025 City-School Election results.
After review of the results, it was determined that the Cherokee Ward 2 Council position had no clear winner due to four persons receiving two (2) write-in votes each. There were fourteen (14) other write-in names receiving one vote each for the Ward 2 Council position.
Per Iowa Code 50.44: “If more than the requisite number of persons are found to have an equal and the highest number of votes, the election of one of them shall be determined by lot. The name of each of such candidates shall be written on separate pieces of paper, as nearly uniform in size and material as possible, and placed in a receptacle so that the names cannot be seen. In the presence of the board of canvassers, one of them shall publicly draw one of such names, and such person shall be declared elected. The result of such drawing shall be entered upon the abstract of votes and duly recorded, and a certificate of election issued to such person, as provided in this chapter.”
Slips of paper with the four write-in names with the highest vote totals (Dan Morrow, Derek Nixon, Logan Patterson, Dave Wilberding) were placed in a basket and one was drawn by the supervisors. Logan Patterson was anonymously drawn and certified as the winner of the Cherokee Ward 2 Council position.
Per Iowa Code 376.11 related to Write-in votes in City Elections: “If a person who was elected by write-in votes chooses not to serve in that office, the person shall submit a resignation in writing to the city clerk not later than 5:00 p.m. on the tenth day following the canvass of the election. Following the resignation of a person who was elected by write-in votes, the city clerk shall notify the person who received the next highest number of votes cast for the office that the person may assume the office. If there is more than one person who received the next highest number of votes cast for the office, lots shall be drawn pursuant to section 50.44 to determine the person who received the next highest number of votes.”
Slips of paper with the remaining three write-in names with the highest vote totals (Dan Morrow, Derek Nixon, Dave Wilberding) were placed in a basket and one was drawn by the supervisors. Dan Morrow was anonymously drawn as the second highest write-in candidate for the Cherokee Ward 2 Council position.
Motion by Ellis, seconded by Skou to approve Resolution #2025-21 Certification of the Cherokee County Canvass of 2025 City-School Election results. Roll call vote: Mullins-aye, Ellis-aye, Bellefy-aye, Skou-aye, Petersen-aye. Motion carried and resolution adopted with details as follows:

Kris Glienke, Cherokee County Auditor and Commissioner of Elections, reviewed procedures and results of a post-election audit called by the Secretary of State in all 99 counties. A four-member board consisting of absentee board members met at the Cherokee County Courthouse on Monday, November 10, 2025 to verify the votes cast at the #6 Quimby Precinct during the November 4, 2025 City-School Election. The Cherokee County Auditor and Election Staff were also in attendance to observe the process. The audit team hand counted the votes cast for the office of Mayor on the 77 ballots cast at the Quimby polling site on election day. The team’s hand counted results were then compared to those reported by the ballot tabulator results tape generated at the polls on election night and found the results matched exactly. Extensive testing of the ballot tabulators is conducted by the Auditor’s Office in advance of every election to assure that the tabulators are accurately recording the votes from the paper ballots.
Motion by Skou, seconded by Bellefy to certify the 2025 City-School Election Post-Election Audit results of the hand count of 77 ballots cast in the #6 Quimby Precinct for the office of Mayor which exactly matched the results tape of the ballot tabulating machine on election day. Motion carried.
Motion by Ellis, seconded by Bellefy to acknowledge a separation of employment and $3,062.69 final payout of hours worked and vacation hours for Brianna Snyder, Dispatcher, effective November 4, 2025. Motion carried.
The supervisors provided committee reports and reviewed meeting schedules.
There being no further business, Chairman Petersen called for a motion to adjourn the meeting.

PUBLIC NOTICE OF STORM WATER DISCHARGE
Schmillen Construction, Inc. plans to submit a Notice of Intent to the Iowa Department of Natural Resources to be covered under the NPDES General Permit #3 “Storm Water Discharge Associated with Industrial Activity From Asphalt Plants, Concrete Batch Plants, Rock Crushing Plants, And Construction Sand And Gravel Facilities”.
The storm water discharge will be from concrete recycling located at SE¼ #28 Sheridan Twp T92N – R41W Cherokee County.
Storm water will be discharged from one point source and will be discharged to the following streams: unnamed tributary to the Rock Creek.
Comments may be submitted to the Storm Water Discharge Coordinator, Iowa Department of Natural Resources, Environmental Protection Division, 502 E. 9th Street, Des Moines, IA 50319-0034. The public may review the Notice of Intent from 8 a.m. to 4:30 p.m., Monday through Friday, at the above address after it has been received by the department.
